This is the judgment in civil suit No. 212 of 2013. The 2nd and 3rd Plaintiffs are a lay Ugandan couple and the 1st Plaintiff is a Non-Governmental Organisation working on health and other human rights awareness and enforcement. This action is brought against the 2nd Defendant in representative capacity under section 10 of the Government Proceedings Act for the actions or inactions of staff of Mulago National Referral Hospital (herein after the hospital), which is a government hospital. The 1st Defendant is sued, not for his individual actions, but in his capacity as the Executive Director of the hospital. The Plaintiffs are represented by Mr. Kabanda David of M/s. Kabanda & Co. Advocates and the Defendants are presented by Ms. Harriet Nalukenge, a senior State Attorney from the Attorney General’s chambers.
